Liability Waiver

1. Assumption of Risk

I, the undersigned, acknowledge that participation in hot yoga and fitness classes at Alive Cape Town, trading as Alive. Heated Fitness ("Alive"), involves inherent risks, including but not limited to, physical injury, heat-related illness, dehydration, and other health conditions. I voluntarily assume all risks associated with my participation in these activities.

2. Medical Condition

I confirm that I am in good physical condition and have no medical condition or injury that would prevent me from safely participating in hot yoga and fitness classes. I understand that it is my responsibility to consult with a physician before participating in any exercise program, including hot yoga and fitness classes, especially if I have any existing medical conditions or concerns.

3. Release of Liability

In consideration of being permitted to participate in hot yoga and fitness classes at Alive, I hereby release, waive, discharge, and hold harmless Alive, its owners, instructors, employees, agents, and representatives from any and all claims, demands, actions, or causes of action arising out of or related to any injury, illness, or damage that I may suffer while participating in these activities, whether caused by negligence or otherwise.

4. Indemnification

I agree to indemnify and hold harmless Alive, its owners, instructors, employees, agents, and representatives from any and all liabilities, claims, damages, and expenses (including reasonable attorney’s fees) arising out of or related to my participation in hot yoga and fitness classes.

5. Emergency Medical Treatment

I consent to receive emergency medical treatment in the event of injury, accident, and/or illness during my participation in hot yoga and fitness classes at Alive. I understand that I am responsible for any and all medical expenses incurred as a result of such treatment.

6. Personal Property

I understand that Alive is not responsible for any loss, theft, or damage to my personal property while I am on the premises.

7. Compliance with Rules

I agree to follow all rules and regulations set forth by Alive for the safety and well-being of all participants. I understand that failure to comply with these rules may result in the termination of my participation in classes without refund.

8. Photographs and Videos

I consent to the use of any photographs or videos taken of me during classes for promotional purposes, including on social media, websites, and marketing materials. I will make it known to the instructor and studio owner should I not be comfortable in this regard.

9. Contractual Obligation

If any provision of this Liability Waiver is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

10. Governing Law

This Liability Waiver shall be governed by and construed in accordance with the laws of the Republic of South Africa.
